Costs of a patent, costs of a trademarke, costs of a design

Initially, we recommend that you contact us briefly by telephone - so that we can ‘sort’ the relevant topics.

Patent/utility model

Roughly speakting, the costs for a German patent application start at about €3,300, whereas for a (more widely territorially valid) European patent application they start at about €5,600. We would be happy to provide a quote for other national or international applications (e.g. internationally as PCT, or individually, e.g. for the USA, Canada, Japan, France, etc.) if required (during the application phase, comparable to EP).

In order to save costs in the subsequent examination procedure at the patent office, it is always advisable to carry out a so-called
novelty search in patent databases (here at the law firm) in advance. This not only offers the advantage of being able to find ‘direct hits’ in the state of the art that may be detrimental to novelty.
Above all, your drafted patent application will be better if you can distinguish it from the known state of the art as you are already formulating it.
At the end of the novelty search, you will also have an idea of a potential scope of protection.

This step-by-step approach is very useful for optimising the cost-effectiveness of the process.
Based on our experience, a novelty search costs between €1,500 and €2,000 (optional).

WIPANO funding may also be available (50% subsidy).

Please contact us if you have any questions.

Trade mark and design

The costs for trade mark or design applications, on the other hand, are considerably lower. It is therefore advisable to contact us in advance by telephone as mentioned above to find out which of these IP rights is the most important and which, if applicable, should be selected optionally and merely as a ‘flanking measure’.

The costs for a Germany-wide application are also lower than, for example, at EU level (as a so-called European Union trade mark or as a Community design).
